Q: If I am convicted of a DWI, can I get DWI SR22 insurance?

A: It depends. In Pennsylvania, there is no one category for DWI, so your ability to file DWI SR22 insurance will depend on just how intoxicated you were and on how many times you have done this before. If this is your first time driving while intoxicated, then you will face the following penalties:

  • Blood alcohol level is 0.08 to 0.099

You will be put on probation for half a year, need to pay over a fine of three hundred dollars, attend a school for alcohol safety, and be required to be treated for your problem with drugs or alcohol.

  • Blood alcohol level is 0.10 to 0.159

You’ll only be able to file SR22 DWI insurance after your license has been suspended for a year; you may spend as much as six months in jail; you may pay a fine for as much as $5,000; you will have to be treated and learn about alcohol safety.

  • Blood alcohol level is 0.16+

Your penalties will be the same as the second level of intoxication, the only difference being that the least amount of time you can spend in jail will be three days.
